Well, it is being fixed by having people play off a USB key. I went from all low settings, 60 and less FPS and stutter on my HDD (new this year) to 120 solid FPS and all high settings. Just saying:) You know USB speeds are slower then normal HDD's correct? And having to do I/O will not increase your graphics settings by much. I am having problems copying an existing copy of D3 over to a new laptop.
I copied everything onto a portable HD and then to my laptop but I'm still having problems starting the game up. I have tried it through both the battle.net launcher and simply by starting the file in the Diablo 3 folder, now located on my laptop. The game has never started but I do get the new Diablo 3 overlay and the launcher updates that the game is running. I'm wondering if it's a Windows 8.1 problem, possible a settings problem or maybe something else I haven't though of.

Edit: I have also tried using the scan and repair function through the battle.net app. This doesn't work, I tried copying it from my desktop to my laptop, ran the scan for blizzard games and if found D#, but said it needed updated. Odd since it is up to date on my desktop. The update tries to run and gives me an error that the update is 15GB and I only have 14GB free (120GB SSD). I also tried the scan & repair option since I know all the files are there and after it's finished scanning it gives me the same error.
To get it working I had to delete one of the MPQ files, it then 'prepared' my files for an update and dowloaded 5GB worth of files that were already installed. Bravo for Blizzard's!@#$ty updater and wasting several hours to download files that were already installed. I worked it out 100% Download the battle.net app on the 2nd computer and start the install of D3, once config is done and data starts to download pause the install.
Once paused go to computer 1 and find the D3 folder and find 'diablo III/data/data' Either USB or share the folders over a network and copy the 13 x 1 gig files to the from computer 1 to computer 2 in the same structure and then when finished go back to the battle.net app and start the download process again. There will be about 400mb of data, left over which is a lot better then 13.5gig. Once finished click play and should work and then run over your display and control settings and off you go. In fact, you don't actually need to even install them. For instance you can put D3 on a USB drive and play from there without doing any form of install. Once I did that, the update went smoothly and there was only another 14MB left to download.
